1. INTRODUCTION

Welcome to Repair Rangers ("Platform"). These Terms and Conditions ("Terms") govern your access to and use of the Repair Rangers website, mobile application, and services (collectively, the "Services").

Please read these Terms carefully before using our Services. By accessing or using our Services, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the Services.

Repair Rangers operates as a marketplace that connects customers seeking maintenance and repair services ("Customers") with independent service providers ("Service Providers") who offer such services. Repair Rangers does not itself provide maintenance or repair services.

2. DEFINITIONS

• "Agreement" means these Terms and Conditions.
• "Customer" means any individual or entity that uses the Platform to request services.
• "Service Provider" means any individual or entity that offers and provides services through the Platform.
• "User" means any person who uses the Platform, including Customers and Service Providers.
• "Content" means text, graphics, images, music, software, audio, video, information or other materials.

3. ELIGIBILITY

You must be at least 18 years of age to use our Services. By using our Services, you represent and warrant that:

• You are at least 18 years old.
• You have the legal capacity to enter into binding contracts.
• You will comply with these Terms and all applicable local, provincial, and national laws and regulations.
• If you are using the Services on behalf of a business entity, you have the authority to bind that entity to these Terms.

4. ACCOUNT REGISTRATION

4.1 Account Creation

To access certain features of the Platform, you must register for an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.

4.2 Account Security

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account. We cannot and will not be liable for any loss or damage arising from your failure to comply with the above requirements.

4.3 Verification

Service Providers may be required to undergo background checks, verification of qualifications, and other screening procedures as determined by Repair Rangers. Service Providers agree to provide all necessary information and documentation for these verification processes.

5. PLATFORM USAGE

5.1 Customer Responsibilities

As a Customer, you agree to:

• Provide accurate and complete information when requesting services to receive the most precise quotation and service
• Communicate clearly about service requirements.
• Provide reasonable access to your property as necessary for service completion.
• Pay for services in accordance with the agreed terms (refer to 6.1).
• Treat Service Providers with respect.
• Customer needs to ensure closure of ticket on the platform upon completion of services delivered
• Provide honest and fair feedback and ratings.

5.2 Service Provider Responsibilities

As a Service Provider, you agree to:

• Provide accurate and complete information regarding your qualifications, skills, and services.
• Maintain all necessary licenses, certifications, and insurance required to perform your services.
• Perform services with reasonable skill and care, in a professional and workmanlike manner.
• Adhere to scheduled appointments and communicate promptly regarding any changes or delays.
• Provide clear and accurate estimates for services.
• Comply with all applicable laws, regulations, and industry standards.
• Treat Customers with respect and professionalism.

5.3 Prohibited Activities

You agree not to:

• Use the Platform in any way that violates any applicable laws or regulations.
• Impersonate any person or entity or falsely state or otherwise misrepresent your affiliation with a person or entity.
• Interfere with or disrupt the Services or servers or networks connected to the Services.
• Attempt to gain unauthorized access to any portion of the Platform or any other systems or networks connected to the Platform.
• Use the Platform to transmit any viruses, malware, or other malicious code.
• Use the Platform to harass, abuse, or harm another person.
• Post false, misleading, or deceptive content.
• Use the Platform for any illegal or unauthorized purpose.

6. FEES AND PAYMENT

6.1 Service Fees

Customers agree to pay the booking fees for services as quoted by Service Providers through the Platform whereby the final amount will be paid once the job is completed to the service provider. All fees are displayed in South African Rand (ZAR) and include applicable taxes unless otherwise stated.

6.2 Platform Fees

Monthly subscription fees will be charged to Service Providers by Repair Rangers for active use of the platform. The monthly subscription fee will be communicated to Service Providers during registration and may be updated from time to time.

6.3 Payment Processing

Payments are processed through our secure payment system. By using our payment services, you agree to comply with our payment policies and the terms of any third-party payment processors we use.

6.4 Cancellation and Refunds

Our cancellation and refund policies are as follows:

• Customers may cancel a service request with a 5% penalty within a 4 hour timeframe specified at the time of booking.
• If customer cancels a booking within 4 hours of the scheduled time, then the booking fee is forfeited
• If a Service Provider fails to attend a scheduled appointment without reasonable notice, the Customer may be entitled to a full refund (Booking fee) or reschedule. Refund (booking fee) is subject to logging a claim through the app process

7. RATINGS AND REVIEWS

7.1 Feedback System

Our Platform includes a feedback system that allows Customers to rate and review Service Providers and vice versa. This feedback helps maintain the quality of our community.

7.2 Guidelines

All ratings and reviews must:

• Be truthful and based on actual experiences.
• Not contain offensive, abusive, or inappropriate language.
• Not include personal information about other users.
• Not be used to coerce or blackmail other users.

7.3 Review Moderation

Repair Rangers reserves the right to remove or edit reviews that violate our guidelines or these Terms.

8. INTELLECTUAL PROPERTY

8.1 Platform Content

The Platform and its original content, features, and functionality are owned by Repair Rangers and are protected by South African and international copyright, trademark, and other intellectual property laws.

8.2 User Content

You retain any rights you may have in Content you submit, post, or display on or through the Platform. By submitting, posting, or displaying Content on or through the Platform, you grant Repair Rangers a worldwide, non-exclusive, royalty-free license to use, copy, reproduce, process, adapt, modify, publish, transmit, display, and distribute such Content.

8.3 Feedback

If you provide feedback, ideas, or suggestions regarding the Platform ("Feedback"), you agree that Repair Rangers shall have a royalty-free, worldwide, irrevocable, perpetual license to use and incorporate such Feedback into the Platform without any obligation to compensate you.

9. PRIVACY

Your privacy is important to us. Please review our Privacy Policy, which explains how we collect, use, and disclose information about you.

10. DISCLAIMER OF WARRANTIES

THE PLATFORM AND SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. REPAIR RANGERS DISCLAIMS ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

REPAIR RANGERS DOES NOT WARRANT THAT THE PLATFORM WILL FUNCTION WITHOUT INTERRUPTION OR ERRORS. REPAIR RANGERS IS NOT RESPONSIBLE FOR THE QUALITY, SAFETY, RELIABILITY, LEGALITY, OR ANY OTHER ASPECT OF ANY SERVICE PROVIDED BY SERVICE PROVIDERS THROUGH THE PLATFORM.

11. LIMITATION OF LIABILITY

11.1 Release

You release Repair Rangers from all liability related to:

• Disputes between Customers and Service Providers.
• The quality or performance of services provided by Service Providers.
• Any damage to property caused by Service Providers.
• Actions or omissions of users of the Platform.

11.2 Limitation of Damages

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL REPAIR RANGERS BE LIABLE FOR ANY INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL, CONSEQUENTIAL DAMAGES, OR ANY DAMAGES WHATSOEVER INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF USE, DATA, OR PROFITS, ARISING OUT OF OR IN ANY WAY CONNECTED WITH THE USE OR PERFORMANCE OF THE PLATFORM.

11.3 Cap on Liability

IN NO EVENT SHALL REPAIR RANGERS' INHERIT LIABILITY FOR ANY WORKMANSHIP, DAMAGES, LOSSES CARRIED OUT BY SERVICE PROVIDERS.

13. TERM AND TERMINATION

13.1 Term

These Terms shall remain in full force and effect while you use the Platform.

13.2 Termination by You

You may terminate your account at any time by following the instructions on the Platform or by contacting us at support@repairrangers.online.

13.3 Termination by Repair Rangers

Repair Rangers may terminate or suspend your account and access to the Platform at any time, without prior notice or liability, for any reason, including if you breach these Terms.

13.4 Effect of Termination

Upon termination, your right to use the Platform will immediately cease. All provisions of these Terms which by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

14. DISPUTE RESOLUTION

14.1 Informal Resolution

If you have a dispute with Repair Rangers, you agree to contact us first and attempt to resolve the dispute informally by sending a notice to support@repairrangers.online.

14.2 Arbitration

If a dispute cannot be resolved informally, you and Repair Rangers agree to resolve any dispute through binding arbitration in accordance with the rules of the Arbitration Foundation of Southern Africa.

14.3 Small Claims

Either party may bring an individual action in small claims court rather than through arbitration if the claim qualifies for its jurisdiction.

14.4 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Republic of South Africa, without regard to its conflict of law provisions.

15. CHANGES TO TERMS

We may modify these Terms at any time. If we make material changes to these Terms, we will notify you by email or through the Platform. Your continued use of the Platform after such notification constitutes your acceptance of the modified Terms.

16. GENERAL PROVISIONS

16.1 Entire Agreement

These Terms, together with the Privacy Policy, constitute the entire agreement between you and Repair Rangers regarding the use of the Platform.

16.2 Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.

16.3 Waiver

The failure of Repair Rangers to enforce any right or provision of these Terms will not be deemed a waiver of such right or provision.

16.4 Assignment

You may not assign or transfer these Terms without the prior written consent of Repair Rangers. Repair Rangers may assign or transfer these Terms without restriction.

16.5 Notices

Any notices or other communications provided by Repair Rangers under these Terms will be given by posting to the Platform or by email to the address you provide during registration.
